I just had a conversation with MM Edge via YM regarding my ban for ks.
After discussions with Edge he explained to me why i was banned, yet this is not clear enough in the rules. Here are the ks rules, and please draw attention to the bold sections:

    12. KS-ing players on a Party (Rule available only on NoN PvP Servers)

    Party full = 4/5 players

In arena, the spots are available on a first come first served basis. This means that if one full party is on the spot, you can’t ks them or you will suffer the penalty.

The player alone in one spot can keep the spot for himself and not have to party other players. It's not considered ks if another player or party (not full) comes and atacks on a spot where a player or not full party atacks if the player/party(not full) allready refuzed to join their party.

A spot is free for all as long as is not ocuppied by a full party.

One player or an incomplet party is obligated to leave the spot if a full party comes to take over.

A spot occupied by a full party can be take over only according to the rulle of AFK

In an illegal KS/takeover (full party ks-ing/taking over another full party's spot) all the members of the offending party will be punished.

In the situation of arena's cages, all players from party must be inside the cage. In the situation of others map's spots, the componence of the party and the presence must be visible in print. Getting out from the cage or leaving the spot, of one or more players, brings the risk of a pk or take over. Only in cases when one or more players from party have no reset, they can stay away from spot but not to a far distance and not outside the cage.

When faced with a KS situation, a player must take the following measures:
    - 1 screen-shot when killing mobs alone (with party) on a spot
    - 1 screen-shot with the KS starting to happen
    - 1 screen-shot with the KS-er refusing party (usefull but not mandatory)
    - 1 sreen-shot taken 3minutes(or more) after the KS-ing occured
    - all above screen-shots must be taken with C pressed so we can clearly see on which server the situation occurs.
Note: If a player refuzes to party, then the player requesting party can KS legally

These rules are in direct contradiction to what Edge has explained is me committing supposedly "illegal" ks.

If i am guilty of ks, when it is only 1 player then why do the rules say i am not guilty?

The player alone in one spot can keep the spot for himself and not have to party other players. It's not considered ks if another player or party (not full) comes and atacks on a spot where a player or not full party atacks if the player/party(not full) allready refuzed to join their party.

So, you as a player on server 1 go on a spot and find one player alone making xp, now what you can do:
Situation 1) you start making xp on the same spot with the player without saying anything, without trying to party him and continuing to make xp even if that player tells you not to - this case leads to your suspend if the player reports you

Situation 2)you give party to that player- here 2 things can happen:
    a) the player accepts your party, you make party together and xp- in this case everyone is happy
b)the player is afk/ do not accept party- in this case the spot becomes yours and the player is ks-ing you- in this case you can report him or call a GM to move him in case that the player is afk

Yes that is what Edge explained to me.

My problem was that i didn't have a screen shot of him refusing my party invitation when i first arrive at the spot.

Does this rule not leave any afk character open for ban?

well next time when you want to make xp on a spot already ocuppied give that guy party and if he refuses make 1 print then you can ks legaly

that print is your prove ( "get out of jail card" ) for your good intentions and also if he reports you...you can show that print

unfortunately this is true, but that why server 3 exists, if you want to let afk without party, just you alone on spot, find a spot on server 3 and make xp there, on server 3 ks rule is not applied, so no suspend for ks-ers.
For you to understand why this rule was introduced on server 1 is because the players tend to be egoists and do xp by themselves without doing party and we wanted to force a bit the creation of parties on server 1
